Summary, etc. | Republic Act 6975 establishes the Philippine National Police (PNP) under the Department of the Interior and Local Government (DILG). Section 25, Chapter III thereof provides for its organization. Section 30, Rule VII of the Implementing Rules and Regulations of the act and in accordance with the broad guidelines set forth therein, recommend the organizational structure and staffing pattern of the PNP to the National Police Commission (NAPOLCOM)". NAPOLCOM in its resolution numbered 92-36, approved revised organizational structure of the PNP thus, the activation of the Directorate for Research and Development (DRD) imbibing a conspicuous role in the PNP organization which is to conduct research studies pertaining to criminalistics equipment and investigative equipment/materials, communication-electronics and transportation, weapons and clothing for effective and efficient maintenance of law and order and public safety function and to uphold the furtherance of self-reliant development projects of the PNP. With the vision to standardized state of the art equipment and world class uniforms and accoutrements, all PNP arms, equipment and uniforms will have the accurate set of standard specifications preceding its procurement and use. The PNP through the Uniform and Equipment Standardization Board (UESB) whose Chairman is concurrently the Director, DRD along with its Technical Committees must widen and expand all possible means and strategies in formulating/updating the standard specifications by utilizing and maximizing the technical expertise of its members before it approve a propose standard specifications by the end-user. Further, these standard specifications approve by the PNP will be endorse to the NAPOLCOM for approval as mandated by Section 13(a)(8), Title III, Republic Act 6975 and amended by Section 5(a)(8), Title III, Republic Act 8551, the NAPOLCOM shall exercise the following powers and function over the PNP, exercise administrative control and operational supervision which shall mean power to prescribe minimum standards for arms, equipment, and uniforms and, after consultation with the Philippine Heraldry Commission, for insignia of ranks, awards, and medals of Honor before it can be use as standards for the procurement of arms, equipment and uniforms of the PNP. In the procurement of arms, equipment and uniforms at the PNP, the standard specifications approve by the NAPOLCOM is the same technical specifications that is being use and included in the bidding documents. More often the procurement process in the PNP does not materialize for reason that the existing standard specifications are no longer responsive or outdated. for the PNP to amend the standard specifications and have it approve by the NAPOLCOM would take some time. Additionally, the interpretation of the law for the NAPOLCOM to prescribe the minimum standards is somewhat misnomer because they are not prescribing but merely reviewing/scrutinizing the recommendations made by the PNP and later issue a resolution setting it as the standard specifications for the PNP. This scholar identified three options to deal with this policy problem. After a careful evaluation based on effectiveness, efficiency, social equity and administrative feasibility, this scholar recommend that the NAPOLCOM to give full authority to the PNP in determining the technical specifications to be use for procurement of arms, equipment and uniforms. |
