Summary: Social stigma, lack of financial support and other services, post traumatic-stress disorder, victim-blaming, long legal proceedings, exposure to threats and security risks, insensitive remarks, degrading or humiliating handling of victims by law enforcers and officers of the court including prosecutors, re-victimization, all of these are the factors why rape incidents are not reported by rape victims. These are also the reasons rape victims do not continue to file the case in Court, withdraw the case or no longer appear during trial. Frequently, rape vicitms are not only physically but also psychologically violated. They have to consider many factors before reporting the crime or they falter after filing the case and withdraaw it eventually. In the Philippines Justice System, conviction rate in rape cases is only 19% in 2016. Many rape victims, mostly children, still continue to suffer injustice. This paper will show the date statistics of the reported rape incidents here in the Philippines but acknowledges that the recorded data provided by the Philippine National Police (PNP) is not the accurate representation of the actual rape incidents, as many are still unreported. This paper will also show the data of rape cases filed before the Prosecutor's Office and the Courts and the percentage of conviction as well as the propensity in which rape victims withdraw their filed rape cases. The author also gathered data as to the factors why rape cases are not reported or if reported, are eventually withdrawn before the legal proceedings are through. Market failures and goverment failures were identified and along with the data gathered and related studies, this author will present the re-victimization of rape victims is one of the reason many rape cases are withdrawn from Court, hence resulting to injustice to rape victims.
